Terms & Conditions

Brand Sports Photography Awards

These Terms & Conditions (the "Terms") govern your use of the website at www.brandsportsphotographyawards.com (the "Website") and your entry into the Brand Sports Photography Awards (the "Awards"). The Awards are operated by World Sports Photography Awards Ltd, trading as Brand Sports Photography Awards, a company registered in England and Wales with company number 11040160, whose registered office is at 20-22 Wenlock Road, London N1 7GU ("we", "us", "our"). "Entrant" means the individual or business that submits an entry, and "you" means any user of the Website or any Entrant. By using the Website or submitting an entry, you agree to these Terms.

Before entering, please read in particular section 3 (your rights and permissions in the images), section 7 (shortlist, winners and the ceremony) and section 9 (liability).

‍

1. Eligibility

1.1 The Awards are opento photographers, photography agencies and studios, sports brands and rightsholders, marketing, advertising and creative agencies, and in-house teams that create sports marketing, advertising, sponsorship or brand photography, subject to the category requirements published on the Website.

1.2 Entries must be sports marketing, advertising, sponsorship or brand photography, rather than editorial or news photography, and must meet the relevant category description.

1.4 You must be at least 18 years old to register an entrant account or submit an entry, whether for yourself or on behalf of a business.

1.5 Members of the judging panel may not enter work in a category they are judging. Our employees and officers may not enter the Awards.

1.6 We may refuse or disqualify any entry at our discretion, including where we reasonably believe an Entrant has misrepresented their identity, authorship, eligibility or rights in an image.

‍

2. Entries

2.2 Each image may be entered only once in any category. Where the same image is entered by more than one party (for example, by a photographer and by the agency or brand that commissioned it), we will contact each party and may combine the entries into a single joint entry credited to all of them or ask the parties to agree which entry stands. We will refund the fee for any entry removed as a duplicate.

2.3 Every entry must credit the photographer who created the image. Where the Entrant is not the photographer, the Entrant must also identify the brand or client and any agency or studio involved.

2.4 Retouching, colour grading and compositing consistent with normal commercial production are permitted, unless a category description says otherwise. Every entry must be substantially based on photographs captured by a photographer. Images wholly or substantially created using generative AI are not eligible, and any use of generative AI beyond routine editing tools must be disclosed at the point of entry.

2.5 We may ask for the original camera files, and for any source images used in a composite, at any stage. If they are not supplied within seven days of our request, the entry maybe disqualified.

‍

3. Rights, permissions and warranties

3.1 By submitting anentry, the Entrant confirms and warrants that:

3.1.1 they are the author of the image, or hold all rights and permissions necessary (including from the photographer, brand, client or agency that created or commissioned it) to enter it and to grant the licence in section 4;

3.1.2  they own the copyright in the image, or hold a licence covering the uses in these Terms, throughout the world;

3.1.3  they have not granted or disposed of any rights in the image that conflict with the uses authorised by these Terms;

3.1.4  they hold all consents, releases and permissions needed for the image to be entered, displayed and promoted as described in these Terms, from any identifiable individual in it (such as athletes, models or participants, including a parent or guardian’s consent for anyone under 18), and from any brand, sponsor, league, club, event owner or client whose marks, kit or property appear in it;

3.1.5  they have told us at the point of entry if any of those permissions will expire within three years of the Awards ceremony, for example because an athlete’s image rights are licensed for a limited campaign period;

3.1.6 the entry does not infringe any third party’s rights and is not unlawful or defamatory; and

3.1.7 all information supplied with the entry is true and accurate.

3.2 If an Entrant becomes aware that any of these warranties is, or has become, untrue, they must tell us promptly, and we will stop further use of the image once we are notified.

3.3 The Entrant will indemnify us against all claims, losses, damages, costs and expenses (including reasonable legal fees) arising from any breach of the warranties in this section 3, or from any claim that our use of an entry in accordance with these Terms infringes the rights of a third party.

3.4 Entrants are solely responsible for the images, descriptions and other content they submit. We do not check the rights position of each entry and accept no liability for entrant content.

‍

4. Licence granted to us

4.1 Entrants keep the copyright and ownership of everything they submit. We claim no ownership of entrant content.

4.2 By submitting an entry, the Entrant grants us a non-exclusive, worldwide, royalty-free licence to reproduce, display, publish and communicate to the public the entry and its credits for the purposes of operating, promoting and documenting the Awards, including:

4.2.1  display of entries, shortlists and winners on the Website;

4.2.2  use in judging materials and on our judging platform;

4.2.3  display at the Awards ceremony and in any associated exhibition, on screen and in print;

4.2.4  use in promotional material for the Awards, including on our social media channels, in newsletters and in press releases;

4.2.5  inclusion in any Awards annual, book or catalogue; and

4.2.6  use in editorial and archival content about the Awards and its winners.

4.3 We may sublicense these rights to press and media covering the Awards; to our sponsors and partners, solely in content promoting their association with the Awards and not in their own product advertising; and to our service providers, solely to operate the Awards. We will require credits to be carried where reasonably practicable.

4.4 We may crop, resize or reformat an entry, or add Awards branding or a credit, to suit the medium in hich it is shown, but will not otherwise alter it.

4.5 This licence does not extend to advertising or merchandise unrelated to the Awards. Any such use will be discussed with the Entrant individually and requires a separate written agreement.

4.6 The licence is irrevocable, save as set out in sections 3.2 and 4.7. For entries that are not shortlisted, it ends when the shortlist is announced, except for our internal judging records and any use already made. For shortlisted and winning entries, it continues for three years from the Awards ceremony for promotional purposes, and indefinitely for archival and historical purposes.

4.7 An Entrant may withdraw an entry at any time before judging is completed, and we will remove it within a reasonable period. We cannot recall promotional material already distributed. Fees for withdrawn entries are not refunded (see section 6.2).

4.8 We will make reasonable efforts to credit the photographer and, where applicable, the brand or client and agency, wherever an entry is displayed. An accidental omission will not be a breach of these Terms, and we will correct it promptly once told.

4.9 No payment is due to an Entrant for any use authorised by this section, other than any prize stated for their category, unless agreed in writing.

‍

5. Judging

5.1 Entries are judged by a panel appointed by us.

5.2 Judges must declare any interest in an entry, including having created, commissioned or worked on it, or being employed by or working for any party credited in it. A judge will not score an entry in which they have declared an interest.

5.3 Judging is based solely on the merit of the entries. Ticket purchases and sponsorship play no part in it. Ceremony attendance affects eligibility only, as set out in section 7.

5.4 The judging panel’s decisions are final, and we will not enter into correspondence about scores or outcomes.

5.5 We may move an entry to a more suitable category, or disqualify an entry at any stage, if we reasonably believe it does not meet the eligibility or category requirements.

5.6 We do not guarantee that any entry will be shortlisted, win an award or receive any particular level of exposure.
